Our total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you to astrotrixum in the twelve (12) months preceding the claim.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • Any errors in the software will be corrected

Indemnification

You agree to indemnify, defend, and hold harmless astrotrixum AG, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit, post, or transmit through our services

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Austria, and you hereby consent to personal jurisdiction and venue therein.

If you are a consumer residing in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under EU law.

Dispute Resolution

We encourage you to contact us first to resolve any disputes. If we cannot resolve a dispute through direct negotiation, any disputes arising out of or relating to these Terms or our services may be resolved through binding arbitration in accordance with Austrian arbitration law, unless prohibited by applicable consumer protection laws.

Termination

These Terms remain in effect until terminated by either party. You may terminate your account and stop using our services at any time. We may suspend or terminate your access to our services immediately, without prior notice or liability, for any reason, including but not limited to:

Upon termination, your right to use our services will cease immediately, and we may delete your account and data, subject to applicable data retention requirements.

Severability
